DUI Myths and Falsehoods:

There are many DUI myths out there that are patently false about DUIs.  A few of the common ones are:

1.  If a test says my blood alcohol level is over .08, I need to plead guilty.

2.  A “wet reckless” is not a DUI.

3.  It is not worth going to trial on DUIs.

4.  It is okay for attorneys to tell you they know the Judge or District Attorney and can get you a special deal somehow.

5.  You should never consider going to trial on a DUI regardless of the circumstances.

6.  It is okay to discuss your case with a “case manager” and not the attorney personally handling the case because it is              okay for someone who just has the title of “case manage” and not an attorney to handle your legal affairs.

7.  The person who owns the law firm is the person who is actually going to represent you at trial.  This is a common scam.         You are scammed by being sold on the name of a famous lawyer, but you never even meet that lawyer.

 How to avoid a DUI

Most DUI arrests in Orange County and Newport Beach occur at night.  Law enforcement have designated  patrol areas where those leaving drinking establishments are most likely to pass through and set up both checkpoints and heavy patrols.  If you can avoid night time driving, it is best to do so.

 A lot of DUI arrest result from a police officer finding an excuse to pull you over just to conduct a DUI investigation.  Make sure your registration sticker is up to date and visible, do not modify for vehicle in any mechanical manner and avoid stickers which tend to attract the attention of law enforce.  If you have a “Grateful Dead” bumper sticker, you are presumed guilty until proven innocent.

If you are pulled over

 If you are over the age of 21 and not on any kind of probation, do not take any field sobriety tests, any preliminary alcohol screening tests, or hand-held breathalyzers and do not answer any questions at all about what you have had to drink.  You have fifth amendment rights.  The officer may also ask you health questions.  In my opinion, this is your business and not police business, why should you have to tell an officer you have cancer, AIDS or even the Flu, it is none of his business.  Just politely decline to answer any question that do not relate to identification until you have a lawyer present.  Do not answer questions about where you were coming from or where  you were going.

 The test you do take is the breath test at the station.  The officer knows the rule, “the harder you blow, the higher you go”, do not listen to the officer and blow so hard that you distort the readings as the officer is trying to make you do.
